Terms and Conditions
This document outlines the terms and conditions ("Terms") governing the use of services provided by National Business Energy, a trading name of Pace Comms Ltd.

For your convenience, key conditions are summarised below, explaining compensation in case of errors, potential charges, and how we earn our fees.

Compensation for Errors: National Business Energy will compensate customers for any loss due to our actions or omissions as detailed in Clause 7.5.

Customer Charges: There is no direct fee for our Switching Service unless a customer cancel after agreeing to a contract, in which case an administration fee may apply (see Clause 4.18).

Commission: We earn commissions from the energy suppliers when we switch or renew your contract. This commission is factored into the rates provided to you; no additional payments are due from you directly. Details of our commission structure are available upon request (see Clauses 5.2 and 5.3).

Terms and Conditions of Service

These Terms apply to all services provided by National Business Energy, a trading name of Pace Comms Ltd. Please read them carefully before using our services. By using our services, you agree to be bound by these Terms and our Privacy Policy available at National Business Energy Privacy Policy.

1. Definitions

National Business Energy: Refers to National Business Energy, a trading name of Pace Comms Ltd, registered in England and Wales (Company No. 07926308), with its registered office and trading address at 5 Castle Court, Cartway, Bridgnorth, Shropshire, England, WV16 4BG, and VAT registration number GB131423263.

Customer: Any non-domestic commercial entity eligible for our services.

Services: Includes our Price Comparison Service, Digital Renewal, Switching Service, and Contract Checking Service.

Supplier: Any third-party energy or utility provider.

Quotation: A proposal outlining terms and prices from a Supplier.

Switching Service: Facilitates the transfer or renewal of energy contracts for the Customer.
2. Application of Terms
2.1 These Terms supersede any other terms provided elsewhere, unless explicitly agreed in writing by an authorized representative of National Business Energy.
2.2 Additional terms may apply to certain services and will be provided on the Site or directly to you.
3. Eligibility and Registration
3.1 To use our services, you must register via our Call Centre or Site. We reserve the right to refuse registration.
3.2 Eligibility requirements include:

Being a UK-based business.

Aged 18 or over (if a sole trader).

Meeting our or the Supplier's credit score criteria.

Providing accurate and complete information.
4. Provision of Services

Price Comparison Service:
4.1 We act as an agent for Suppliers. The contract for energy supply is between you and the Supplier, governed by the Supplier’s terms.
4.2 We do not guarantee the lowest market prices but provide information based on data from Suppliers.
4.3 Quotations provided are valid for the period stated on the Quotation or as otherwise notified.
4.4 It is the Customer's responsibility to review the Quotation and Supplier Contract terms before accepting them.
4.5 Prices quoted are based on Supplier information; accuracy or completeness is not guaranteed.
Switching Service:
4.6 We facilitate the transfer to a new Supplier upon acceptance of a Quotation.
4.7 Supplier terms govern the actual transfer; we are not liable for delays caused by Suppliers.
4.8 We are not liable for failures in the Switching Service caused by the Supplier, Existing Supplier, or Customer's existing Supplier’s terms, debts, or objections.
4.9 We provide information with reasonable skill but do not guarantee its accuracy.
4.10 We are not liable for losses due to reliance on our information.
4.11 By accepting a Quotation, the Customer authorizes us to negotiate and secure new Supply Contracts on their behalf.
4.12 Customers must provide all necessary information and documentation for the Switching Service.
4.13 Delays or rejections may occur if required information is not provided.
4.14 We may pass necessary information to Suppliers to complete the Switching Service.
4.15 We reserve the right to refuse the Switching Service at our discretion.
4.16 Providing false or misleading information may result in termination and potential costs.
4.17 Additional Supplier terms, such as credit checks and deposits, may apply.
Contract Cancellation Administration Fee:
4.18 If a customer cancels after accepting a Quotation, an administration fee may be charged.
5. Commissions
5.1 We receive commissions from Suppliers, included in the rates offered to you.
5.2 Commission details are based on estimated consumption and our agreement with Suppliers.
5.3 No additional payments are due from you directly.
5.4 We may continue to receive commissions after the Supplier Contract ends if not renewed or switched.
5.5 Commission details are available upon request.
6. Termination
6.1 We may terminate services immediately for breaches of these Terms or provision of false information.
6.2 You may terminate services at any time with written notice.
7. Limitation of Liability
7.1 We are not liable for losses resulting from Supplier actions or information inaccuracies.
7.2 We are not liable for losses due to Supplier delays or failures.
7.3 We are not liable for losses due to false information provided by the Customer.
7.4 We are not liable for failures in the Switching Service caused by the Supplier, Existing Supplier, or Customer’s existing Supplier’s terms, debts, or objections.
7.5 Our liability for any service-related loss is limited to the administration fee paid.
8. Complaints
8.1 Contact our Customer Service team for any complaints. We will investigate and address issues promptly.
9. General
9.1 These Terms are governed by English and Welsh law.
9.2 Any disputes will be resolved in the courts of England and Wales.
9.3 We may amend these Terms from time to time, with updates posted on our Site.
9.4 If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in force.
9.5 No failure or delay by us to exercise any right or remedy constitutes a waiver of that or any other right or remedy.
9.6 These Terms constitute the entire agreement between you and National Business Energy.
